for the weekend LLC (the “Company,” “we,” “us,” “our,” “FTW”) respects your privacy and is committed to protecting it through our compliance with this policy. For the purposes of this Privacy Policy Notice (this “Privacy Notice”), “you” and “your” means you as the user of the Services (defined below). This policy describes:

  • The types of information we collect, use and disclose about you when you create an account on, access or use our website (fortheweekend.io) (our “Website”) or purchase, download, install, create an account on, access or use our related mobile applications (the “App”), and any tools, features and functionality offered on or through the Website or App (collectively, the “Services”); and
  • Our practices for collecting, using, maintaining, protecting and disclosing that information.

This Policy does not apply to:

  • Information collected offline or through any other Company website, except as specified herein, including websites you may access through this App.
  • Information provided or collected by any third party, including other apps, websites, or content that may link or be accessible from or through this App.

Please read this Privacy Notice carefully. By using any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Notice. If you do not agree to this Privacy Notice, please do not use or access the Services.

Please note that the Services are designed for users in the United States only and are not intended for users located outside the United States. By using the Services, you acknowledge and agree that our Services are not intended for minors under 18 years of age, and that we do not knowingly collect personal information from anyone under 18.

If we become aware that we have collected personal information from anyone under 18 years of age, we will promptly delete such information from our records. If you are the parent or guardian of a minor under 18 years of age who has provided us with their personal information, you may contact us at legal@fortheweekend.io to request that it be deleted.

1. Changes to This Privacy Notice

We may modify this Privacy Notice from time to time, in which case we will update the “Last Modified” date. If we make material changes to the way in which we use information we collect, we will notify you by email (sent to the email address specified in your account) or through a prominent notice on this page at least thirty (30) days prior to the changes taking effect, and we will take any additional steps required by applicable law. If you do not agree to any updates to this Privacy Notice, please do not access or continue to use the Services.

2. Collection of Your Information

When you use or access the Services, we collect certain information about you from a variety of sources, as described below.

Information You Provide to Us

When you download, create an account, or use this App or the Services, sign up for our newsletters or alerts, or communicate with us or other users via our Services, by social media or otherwise, we may ask you to provide information or you may provide information when you use the App:

  • By which you may be personally identified, such as name, email address, shipping address, phone number, social media handles and driver’s license or other government-issued identification information, or any other information the App collects that is defined as personal or personally identifiable information under an applicable law (“personal information”); and/or
  • That is about you, but individually does not identify you.

The information includes:

  • Contact and identity information, such as name, email address, shipping address, phone number, and social media handles. We may also collect driver’s license or other government-issued identification information only when necessary for specific purposes such as identity verification, age verification, fraud prevention, or compliance with legal obligations.
  • Account information, such as username, password, profile photo, Item sizes and birthday. If you choose to register an account, you are responsible for keeping your account credentials safe, and we recommend you do not share your credentials with anyone. If you believe your account has been compromised, please contact us immediately.
  • Information about your use of the Services, such as your preferred size(s)/option(s) for Items, zip code or other location information that you manually provide, information about items that you list, swap, buy, sell or otherwise express interest in, the content of messages that you send or receive from other users, promotion and referral codes and other information about your use of the Services.
  • User-generated content, such as pictures, videos, reviews and any other information that you submit to us for publishing on the Services (“UGC”). We or others may store, display, reproduce, publish, distribute, modify, create derivative works from, publicly perform, and otherwise use UGC in connection with our business operations, including for marketing and promotional purposes. We will use commercially reasonable efforts to attribute UGC to you when practicable, but we are not obligated to do so. By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license to use, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, and otherwise exploit your UGC for any lawful purpose related to our business operations, including marketing and promotional purposes. You retain all ownership rights in your UGC, but you acknowledge that we may continue to use UGC even after you delete your account or remove the UGC from the Services. Others may also have access to UGC and may have the ability to share it with third parties. If you choose to submit UGC to any public area of the Services, your UGC will be considered “public” and will be accessible by anyone, including us.
  • Any other information you choose to include in communications with us, for example, when interacting with us through our online chatbot, sending us an email or responding to surveys. Please note that we use a third-party service provider to power our chatbot, and information you provide through the chatbot may be shared with and processed by this third party in accordance with their privacy policy.

You may also provide information for publication or display (collectively, “User Contributions”) on public areas of the App or websites you access through the App. Your User Contributions are posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, while we implement reasonable security measures to protect your information, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. You acknowledge and accept these risks when posting User Contributions to public areas of the Services.

Information We Collect Automatically

As you use and interact with the App and the Services, we may use automatic data collection technologies (including cookies, web beacons, and similar technologies) to collect certain information about your device and interaction with the Services, including:

  • Device Information. We may collect information such as device type, operating system, unique device identifier, and internet protocol (IP) address.
  • Location Information. We collect location information that you manually provide to us, such as your zip code or city, when you create an account or use the Services. We do not automatically collect real-time or precise GPS-based location data from your device. You may update or delete your manually provided location information at any time by visiting your account profile page or contacting us at info@fortheweekend.io.
  • Stored Information and Files. With your permission, the App may access metadata and other information associated with files stored on your device that you choose to share through the App. This may include, for example, photographs, audio and video clips, personal contacts, and address book information. Please note that photographs and other media files you upload through the App may contain embedded location metadata (such as GPS coordinates) that was recorded by your device at the time the file was created. If you do not wish to share this embedded location data, we recommend disabling location services for your device’s camera application or removing location metadata from files before uploading them. You can control these permissions through your device settings at any time.
  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App.
  • Other Information. Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, clickstream data and referral activity.
  • Cookies (or mobile cookies). A cookie is a small file placed on your device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of our App.
  • Web Beacons. As mentioned, the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide to us.

If you do not want us to collect this information, do not download the App or delete it from your device. You may opt out of location data collection at any time by choosing not to provide it when prompted, or you may update or delete your manually provided location information at any time by logging into your account and visiting your account profile page or by contacting us at info@fortheweekend.io. Please note that removing your location information may disable certain location-based features of the Services. If you upload photographs or other media files through the App, we recommend reviewing and removing any embedded location metadata from those files prior to upload if you do not wish to share that information.

Information Collected From Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us or that is collected from automatic information collection technologies. These third parties may include: advertisers, ad networks, ad servers, analytics companies, your mobile device manufacturer, and your mobile service provider. Information collected includes:

  • Information we receive from other users, including information associated with your personal information or online activities, feedback and reviews posted by other users, and if another user has provided us your information to invite you to use our Services or to send you a gift card.
  • Analytics data we receive from analytics providers such as Google Analytics.
  • Background check information we receive from third-party providers that assist us in conducting such checks, including when relevant to claims of fraud or theft of Items. This information may include driver’s license numbers, other government-issued identification numbers, and related personal information. We will obtain your express consent before conducting any background check, as required by the Fair Credit Reporting Act and certain state law.
  • Information we receive when you choose to interact with us through social media and other third parties, such as when you access the Services through or interact with us on Instagram, Facebook or TikTok.

Third parties may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Any information we obtain from third parties will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. However, when we use third-party information to make material decisions affecting your access to or use of the Services, we will use commercially reasonable efforts to work with reputable third-party providers.

3. Use of Your Information

We may use the information we collect to:

  • Administer and otherwise provide the Services, the App and its contents, and any other information, products, or services that you request from us, including to create and maintain your account, verify your identity and location, process your payments, enable you to connect with other users and list, swap, buy or sell Items.
  • Fulfill any other purpose for which you provide it.
  • Give you notices about your account or subscription, as the case may be, including any expiration and renewal notices.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you when App updates are available, and of changes to any products or services we offer or provide through it.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Monitor and analyze trends, better understand user interactions and experiences and tailor your experience with the Services, including to provide more personalized recommendations based on information such as your zip code, size(s)/option(s) associated with Items and interactions with our chatbot. We may also send you birthday communications if you have provided your birth date and have not opted out of such communications.
  • Conduct internal research and development and to improve and develop our products and services, including to improve the models that power our chatbot.
  • Enhance the safety and security of our Services, such as to conduct troubleshooting, data analysis, testing, system maintenance and reporting, and to investigate and resolve suspected or alleged fraud, violations of our terms or applicable law.
  • Provide customer support, respond to your queries, tell you about products or services that may be of interest and send you announcements in relation to your account and other communications.
  • Comply with applicable legal obligations, enforce our contractual arrangements and policies, and protect or defend the Services, our rights and the rights of our users or others.

We may also use your information to contact you about our own goods and services that may be of interest to you. We do not sell your personal information. By creating an account, you may receive marketing communications from us, which you can opt out of at any time. We will obtain your express opt-in consent before using your information to contact you about third parties’ goods and services. We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personally identifiable information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. We may share de-identified or aggregated information with advertisers for targeting purposes.

4. Disclosure of Your Information

We may also disclose aggregate or de-identified information such that it no longer identifies you and use that information without restriction. We also disclose your information with third parties in certain circumstances, subject to this Privacy Notice, including:

  • With other users of the Services, including when you post items or communicate with other users through the Services.
  • With contractors, service providers, vendors, and other third parties who support our business, including our fulfilment and courier partners, for customer relationship management, payment processing, email marketing, chatbot operation and improvement, data analytics and website hosting.
  • With professional advisors, such as auditors, law firms, or accounting firms.
  • For legal and security reasons and to protect our services and business, such as with regulators, law enforcement agencies, public authorities, or any other relevant organizations, to comply with applicable law or obligations thereunder, including cooperation with law enforcement, judicial orders, and regulatory inquiries, to protect the interests of, and ensure the safety and security of, us, our users, a third party or the public, to exercise or defend legal claims, and to enforce our terms and conditions or other agreements.
  • To a prospective buyer, seller, new owner, or other relevant third party in connection with or anticipation of an asset sale or purchase, a share sale, purchase or merger, bankruptcy, or other business transaction or re-organization (including while negotiating or in relation to a change of corporate control).
  • With our affiliates or otherwise within our corporate group.
  • When you request or authorize us to share certain information with third parties, including through social media widgets.
  • To third parties to market their products or services to you only if you have affirmatively opted in to such disclosures.
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to refer a friend through our App.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, including the Terms of Service, and for billing and collection.
  • If we reasonably believe disclosure is necessary or appropriate to protect the rights, property, or safety of for the weekend LLC, our customers, or others, and such disclosure is permitted by applicable law. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction, subject to appropriate data protection safeguards.

5. Data Security

We implement reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction. Our security measures include encryption and access controls. All data transmitted between the Platform and our servers is encrypted in transit using industry-standard TLS/SSL encryption. Data stored within our backend infrastructure, including Firebase and Google Cloud, is encrypted at rest.

Access to user data is restricted through role-based permissions. Account approval and administrative functions are limited to authorized users, and standard users are limited to accessing their own account information. Access to user data by our development team is limited to a small number of authorized individuals.

We rely in part on the security infrastructure and practices provided by Firebase and Google Cloud, which maintain their own security programs, audits, and certifications.

However, despite our reasonable efforts to protect your information, no security measures are impenetrable, and we cannot guarantee absolute security. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

Data Breach Notification

In the event of a breach of the security of your personal information, we will notify you in accordance with applicable law, including Pennsylvania’s Breach of Personal Information Notification Act (BPINA). If you are a Pennsylvania resident, we will notify you of any breach of your personal information in the most expedient time possible and without unreasonable delay, following our discovery of the breach and our determination that notification is required. Notification will be provided to you via email (to the email address associated with your account), written notice, or, if the cost of providing individual notice would exceed $100,000 or the number of affected individuals exceeds 175,000, by means of a conspicuous notice on our Website and App and notification to major statewide media. If you believe your personal information has been compromised, please contact us immediately at info@fortheweekend.io.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. You should notify us immediately at info@fortheweekend.io if you believe your password has been compromised or your account has been accessed without authorization.

6. Rights and Choices

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. We use Tracking Technologies to collect information about your browsing activities over time and across different websites following your use of our Services. These Tracking Technologies may be placed by us or third parties, including Google, and allow us to recognize and count the number of users and to see how users move around our Services when they are using it. This helps us analyze and improve our products, services and the way our Website and App works and to deliver ads targeted to your interests. Most browsers accept cookies automatically, but you may be able to control the way in which your devices permit the use of Tracking Technologies. If you so choose, you may block or delete our cookies from your browser; however, blocking or deleting cookies may cause some of the Services, including certain features and general functionality, to work incorrectly.
  • Promotion by the Company. If you do not want us to use your contact information to promote our own or third parties’ products or services, you can opt out by sending an email request to info@fortheweekend.io.
  • Unsubscribe from Marketing Emails. In accordance with the CAN-SPAM Act, all marketing and promotional emails we send to you will include a clear and conspicuous mechanism for you to opt out of receiving future marketing emails from us. You may unsubscribe from our marketing emails at any time by: (i) clicking the “unsubscribe” link included in the footer of any marketing email we send you; or (ii) sending an email request to info@fortheweekend.io with “Unsubscribe” in the subject line. We will process your opt-out request within ten (10) business days. Please note that even if you opt out of receiving marketing emails, we may still send you transactional or administrative emails related to your account or your use of the Services, such as account confirmations, password resets, and transaction receipts.

You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. While your browser settings may allow you to transmit a “do not track” signal, “opt-out preference” signal, or other mechanism for exercising your choice regarding the collection of your information online, like many websites, our Website is not designed to respond to such signals. Depending on where you live, you may have certain rights in relation to your personal information under applicable federal and state laws. However, these rights are not absolute, and may apply only in certain circumstances and subject to applicable exemptions and limitations under law. For example, residents in certain states, such as California, may have additional personal information rights and choices.

Pennsylvania Residents

While Pennsylvania does not currently have a comprehensive consumer privacy law, the following federal laws may provide certain protections to Pennsylvania residents depending on the context of data collection and use:

  • COPPA. The Children’s Online Privacy Protection Act applies to the online collection of personal information from children under 13. Our practices with respect to minors are described in this Privacy Notice.
  • GLBA. The Gramm-Leach-Bliley Act may apply to our data practices to the extent that the Services involve financial products or services, including payment processing for item swaps, purchases, or sales conducted through the Services. To the extent GLBA applies, we are required to explain to you our information-sharing practices and to safeguard your nonpublic personal information. We do not sell or share nonpublic personal financial information with non-affiliated third parties for marketing purposes without providing you with the opportunity to opt out of such sharing, except as otherwise permitted by applicable law. 7. Your Privacy Rights: Accessing, Correcting, and Deleting Your Personal Information

You can review and change certain personal information by logging into the App and visiting your account profile page. You can change your information here or contact us at info@fortheweekend.io to request access to, correct, or delete any personal information provided to us. Upon request and subject to applicable legal requirements and exceptions, we will delete your personal information. In some cases, deletion of certain personal information may require deletion of your user account, as certain information is necessary to maintain account functionality. In certain circumstances, we may be required or permitted by law to retain your personal information even after you request deletion, including to: (i) complete transactions for which the personal information was collected; (ii) detect and resolve security incidents or fraud; (iii) comply with legal obligations; (iv) exercise or defend legal claims; or (v) enable solely internal uses reasonably aligned with your expectations.

If you request deletion of your personal information, we may delete your user account, though we may retain certain information as described above. We may decline a request to change information if we believe in good faith that the change would: (i) violate any law or legal requirement; (ii) cause the information to be incorrect or misleading; (iii) compromise the security or integrity of our systems; or (iv) interfere with our ability to comply with legal or regulatory obligations. If we decline your request, we will provide you with an explanation for our decision.

State Privacy Rights

Depending on your state of residence, you may have certain rights regarding your personal information under applicable state privacy laws. These rights may include:

  • The right to access the personal information we collect about you.
  • The right to correct inaccuracies in your personal information.
  • The right to request deletion of your personal information.
